Terms of Service

1. Acceptance of Terms

By accessing or using ExamifyPro (the "Service"), provided by Jean Jabrun LOUIS, operating as sole proprietor (Auto-entrepreneur, SIRET 502 982 853 00033) under the trading name ExamifyPro ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and ExamifyPro. We may update these Terms from time to time, and your continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of Service

ExamifyPro is an online platform that provides exam preparation services through practice questions, mock exams, and study materials across various certification domains. The Service includes:

• Access to a library of practice exam questions
• Mock exam simulations with timed sessions
• Performance analytics and progress tracking
• Explanations and educational content for each question
• Multiple subscription tiers with different feature sets

3. Eligibility

To use the Service, you must:

• Be at least 16 years old
• Have the legal capacity to enter into a binding contract in your jurisdiction
• If aged 16-18, depending on local laws, have parental or legal guardian consent for paid subscriptions
• Provide accurate, current, and complete information during registration
• Not be prohibited from using the Service under applicable laws

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

4. Account Registration

To access most features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update your account information as needed
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access
• Not share your account with others or transfer it
• Not create multiple accounts for fraudulent purposes

We strongly recommend enabling two-factor authentication (2FA) on your account for additional security.

5. Subscriptions and Payments

5.1 Subscription Plans

We offer several subscription tiers with different features and pricing, displayed on our pricing page.

Right to modify pricing: ExamifyPro reserves the right to modify the pricing of its plans and services at any time. Price changes apply immediately to new subscriptions. For existing subscribers, the new pricing will only apply at your next renewal date, and we will notify you by email at least 30 days before that date so you may cancel if you disagree with the new price.

Right to modify these Terms: ExamifyPro reserves the right to modify these Terms of Service and the features of the Service at any time. Material changes will be communicated by email and/or in-app notification. Minor changes (clarifications, corrections, formatting) may be made without notice. Your continued use of the Service after a change constitutes acceptance of the modified Terms.

If you do not agree with any pricing or Terms change, you may cancel your subscription at any time. Refunds for unused portions are governed by our Refund Policy.

5.2 Payment Processing

Payments are processed by Stripe, a third-party payment processor. We do not store your credit card information. By providing payment information, you authorize us (via Stripe) to charge the applicable fees to your payment method.

5.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period (monthly or yearly) at the then-current price. You may cancel auto-renewal at any time from your account settings. Cancellation takes effect at the end of the current paid period; you retain access until then.

5.4 Refunds — 7-Day Refund Policy

We offer a 7-day refund window on new subscriptions, provided you have not started any exam series. To request a refund, contact us at support@examifypro.com within 7 days of your payment.

At checkout, you expressly consent to the immediate provision of the digital service and acknowledge that, by starting to use the Service, you waive your 14-day right of withdrawal under EU law (Article L.221-28 of the French Consumer Code; Directive 2011/83/EU).

Beyond the 7-day window or after starting an exam, refunds may still be granted in exceptional circumstances (billing errors, prolonged service outage, fraud, etc.).

5.5 Failed Payments

If a payment fails, we will attempt to retry the payment several times. If unsuccessful after multiple attempts, your account access will be suspended until payment is resolved. We will notify you by email before any suspension.

5.6 Taxes

Prices are exclusive of applicable taxes (VAT, sales tax) unless otherwise stated. You are responsible for any taxes that apply to your subscription based on your location.

6. User Conduct

When using the Service, you agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws
• Share, sell, redistribute, or republish exam content, questions, or explanations
• Attempt to copy, scrape, or extract content from the Service through automated means
• Reverse engineer, decompile, or attempt to extract source code
• Use the Service to cheat on actual certification exams or violate exam policies
• Attempt to gain unauthorized access to other accounts or systems
• Submit false, misleading, or fraudulent information
• Upload malicious code, viruses, or any harmful content
• Harass, abuse, or harm other users or staff
• Use the Service to send spam or unsolicited communications
• Bypass any security measures or rate limits
• Use bots, scrapers, or automated tools without our written consent
• Impersonate any person or entity

Violation of these rules may result in immediate account suspension or termination without refund.

7. Intellectual Property

7.1 Our Content

All content provided through the Service — including questions, explanations, design, code, logos, and branding — is the property of ExamifyPro or our licensors and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial educational purposes during your active subscription.

7.2 Your Content

You retain ownership of any content you submit to the Service (e.g., support tickets, testimonials, question reports). By submitting content, you grant us a worldwide, royalty-free, perpetual license to use, modify, and display that content as needed to provide and improve the Service.

7.3 Trademarks

"ExamifyPro" and our logo are trademarks of ExamifyPro. Third-party trademarks (e.g., certification names like AWS, PMP, etc.) belong to their respective owners and are used solely for descriptive purposes. We are not affiliated with, endorsed by, or sponsored by these certification organizations.

8. AI-Generated Content Disclaimer

ExamifyPro uses artificial intelligence to generate exam preparation content. We make significant efforts to ensure quality and accuracy, but:

• AI-generated content may occasionally contain errors, inaccuracies, or outdated information
• Content should be used as a study aid, not as a definitive source
• For actual certification exam preparation, always cross-reference with official certification materials
• We provide a question reporting feature; if you find an error, please report it so we can correct it
• Passing a practice exam on our platform does NOT guarantee passing the actual certification exam

9. No Guarantee of Results

ExamifyPro is a study aid. We do not guarantee that using our Service will result in passing any actual certification exam. Exam success depends on many factors including your personal effort, prior knowledge, and the specific exam administrator's policies. We are not affiliated with any certification body.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability or fitness for a particular purpose
• Warranties of accuracy, reliability, or completeness of content
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding the success of your certification exam attempts

You use the Service at your own risk and are solely responsible for any decisions made based on its content.

11. Limitation of Liability

To the maximum extent permitted by law, ExamifyPro and its affiliates, officers, employees, and partners shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from failed certification exams or business decisions
• Damages caused by third parties (Stripe, hosting providers, etc.)
• Damages resulting from unauthorized access to your account due to your failure to maintain credentials

In jurisdictions where this limitation is not allowed in full, our maximum liability shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for gross negligence, fraud, or willful misconduct.

12. Indemnification

You agree to indemnify and hold harmless ExamifyPro, its affiliates, officers, employees, and partners from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) your violation of any applicable law.

13. Termination

13.1 By You

You may terminate your account at any time from your account settings or by contacting support@examifypro.com. Cancellation does not entitle you to a refund beyond our 30-day money-back guarantee.

13.2 By Us

We may suspend or terminate your account at our discretion, with or without notice, if you:

• Violate these Terms
• Engage in fraudulent or illegal activities
• Abuse the Service or harm other users
• Fail to pay applicable fees
• Provide false information

13.3 Effect of Termination

Upon termination, your access to the Service ends immediately. We may delete your data subject to our retention policy (see Privacy Policy). Provisions that by their nature survive termination (e.g., intellectual property, limitation of liability) will remain in effect.

14. Modifications to Service

We may modify, suspend, or discontinue any aspect of the Service at any time, including features, functionality, or availability. We will provide reasonable notice for significant changes that materially affect your subscription. If we discontinue the Service entirely, we will provide a pro-rata refund of any prepaid amounts.

15. Content Moderation (EU Digital Services Act)

We comply with the EU Digital Services Act (DSA) regarding content moderation:

• Notice and action: You can report problematic content via our question report feature or by emailing admin@examifypro.com
• Transparency: Reports are reviewed by our moderation team; you will be informed of decisions
• Appeal: If you disagree with a moderation decision, contact us for review
• No automated moderation: All content moderation decisions are made by humans, not AI

16. Force Majeure

We are not liable for any delay or failure to perform our obligations due to causes beyond our reasonable control, including natural disasters, war, terrorism, pandemics, internet outages, cyberattacks, government actions, or failures of third-party service providers (hosting, payment, email, etc.).

17. Governing Law and Jurisdiction

These Terms are governed by the laws of France, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Paris, France.

For consumers in the EU, this does not affect your statutory rights under the law of your country of residence. You may also bring proceedings in your country of residence.

18. Dispute Resolution

Before initiating any legal action, you agree to first contact us at admin@examifypro.com to attempt good-faith resolution of any dispute. We will respond within 30 days.

For EU consumers, you may also use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr

19. Miscellaneous

• Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and ExamifyPro.
• Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.
• No Waiver: Our failure to enforce any right does not constitute a waiver of that right.
• Assignment: You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
• Notices: We may send notices to you by email or through the Service. You may send notices to us at admin@examifypro.com.
• Language: These Terms are written in English. Any translation is for convenience only; in case of discrepancy, the English version prevails.
